Starsha Silva’s Case Moves Forward: Why It Matters

On May 23rd, 2023, Starsha Silva was in FCI Waseca, struggling to survive with a severe congenital heart condition. On May 24th, she was dead, less than a year into her sentence for a drug conviction. Starsha was 36 years old when she died. She left behind four children.

Her death was avoidable. The law firm Loevy & Loevy filed a complaint for 8th Amendment claims and wrongful death in federal court in 2024 alleging that the BOP ignored doctors who insisted she needed immediate surgery, brought her back to prison, and left her to die. 

The legal process is a grueling marathon, not a sprint. It is painful for the survivors and requires tenacious lawyers. The BOP has made numerous procedural arguments to derail the case. The BOP and the individual defendants filed a motion to dismiss, which the court has now denied in part. To skip the legalese, this means the case will continue and, more importantly, the BOP will eventually be forced to produce documentation and answer questions about Starsha’s death after exhausting its legal maneuvers.

The BOP allegedly tried to cover up the cause of Starsha’s death. The National Council intervened to prevent her body from being cremated and worked with the family to ensure that an autopsy was done. The alleged misdeeds by prison staff will now be examined in a courtroom rather than vanishing with her scattered ashes. Starsha deserves to be remembered, and her case fought for; we are grateful to her lawyers at Loevy & Loevy for their work. Nothing will ever replace Starsha’s life, but those she left behind deserve to be made as whole as they can be.

It is hard to describe this as a “victory.” Starsha is still gone. Her family will never see her again, hug her, or reach any milestones together. This should never have happened in the first place, but by allowing the case to proceed, the courts are acknowledging one vital fact: Starsha Silva’s life mattered.
